TERMS AND CONDITIONS OF ENTRY FOR COMPETITION
1. INTERPRETATION
1.1.Unless otherwise expressly stated, or the context otherwise requires, the words and expressions listed below, shall bear the corresponding meanings:
1.1.1. Affiliates – means any of the Promoter’s related entities, subsidiaries, licensees/licensors, franchisees or joint venture partners;
1.1.2. Competition – the competition as promoted by the Promoter;
1.1.3. CPA – the Consumer Protection Act 68 of 2008 (as amended);
1.1.4. Eligible Entrant – a permanent resident and citizen of South Africa over the age of 18 (eighteen) years old, in possession of a valid South African Identity Document, except any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoter and/or immediate family members of any employee, director, member, partner, agent or consultant or person indirectly or directly in control or controlled by the Promoter. The term "Immediate family members" shall include, but is not limited to; spouse, parents, siblings, grandparents, children and grandchildren.;
1.1.5. Prize/s – There will be two Winners in total. One winner will be chosen for the ‘Social Media entry’, and another winner will be chosen from the ‘book in-store entry’. The total prize pool is R35,000.00 (thirty-five thousand rand only) for each winner, including a Flight Centre travel voucher to the value of R10,000.00 (ten thousand Rand only) and R5 000.00 (five thousand rand only) vouchers from each brand partner valid from date winners are announced. Brand partners’ and Flight Centre voucher Terms & Conditions stipulated in Annexure A.
1.1.6. POPIA – the Protection of Personal Information Act, 4 of 2013 (as amended);
1.1.7. Promoter – the promoter of the Competition is Flight Centre Travel Group Proprietary Limited, Registration Number 1994/000253/07 a company registered and incorporated in accordance with the laws of the Republic of South Africa, and includes its Affiliates;
1.1.8. Promotional Period – the Social Media competition will run from the 12pm 2 December 2024 and end at 12pm 16 December 2024 with Winner to be announced by 12pm on 18 December 2024. The Book in store competition will run from 12pm 2 December and end at 12pm 31 January 2025 with the Winner to be announced by 12pm on 11 February 2025.

1.1.9.4. Entry Option 2: Book in-store
1.1.9.4.1. Book any holiday in-store (packages, flights, cruises, tours, accommodation) between 12PM, on 02 December 2024 and 12PM, 31 January 2025; which must be paid in full. 1.1.9.4.2. Opt-in to Flight Centre Marketing and consent to receive promotional offers via email (Travel expert will do this in Onis ledger profile)
1.1.9.4.3. Follow Flight Centre South Africa on Facebook (https://www.facebook.com/flightcentreRSA) and Instagram (https://www.instagram.com/flightcentrersa/)
1.1.9.5. Flight Centre will verify booking details upon Winner selection, by a representative, in order to qualify Winner
1.1.9.6. All travel bookings made through Flight Centre and fully paid for and funds reflecting in Flight Centres bank account by 12pm the 31 January 2025 are eligible for entry. The booking can be holiday packages, flights, accommodation, cruise or tour. The booking can be for local or international travel. Eligible entrants will be entered into a draw and the Winner will be chosen by means of random draw.
1.1.9.7. Winner/s – an Eligible Entrant who wins the Prize in respect of this Competition.
2. ELIGIBILITY AND ENTRY
2.1. The Competition is open during the Promotional Period to Eligible Entrants.
2.2. In order to enter the Competition, an Eligible Entrant is required to adhere to the Promoter’s stipulated Competition requirements of entry.
2.3. The Competition is only valid within South Africa. Eligible Entrants must be within South Africa at the time of entering the Competition, for the verification process and at the time of the prizes being awarded should they be declared a Winner, failing which such person will be disqualified and the draw of a replacement entry shall take place under the same terms and conditions as the first draw.
2.4. Eligible Entrants may enter this Competition once and are only eligible for 1 (one) Prize under this Competition. There will be 2 (two) final winners chosen by random draw (one winner for the social entry and another winner for the book in-store entry)
2.5. Eligible Entrants who have won a prize in a competition run by the Promoter in the past 6 (six) months, are not eligible to win a Prize.
2.6. The names entered in the Competition must correspond with the names on the Identity Document and passport of the Eligible Entrant.
2.7. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Entries received will be considered final by the Promoter.
2.8. Entries must be received by the Promoter during the Promotional Period. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid and thus disqualified.
2.9. The employees of the Promoter and their immediate families are not permitted to enter the Competition.
2.10. The Winner cannot choose the prize – it will be awarded at the Promoter’s sole discretion.
2.11.The Promoter reserves the right to remove any posts or entries on social media that it deems spam; offensive; political; not in line with the community guidelines of the relevant social media channel; not in line with the Promoter’s values or an infringement of a third party’s intellectual property.
2.12. The Promoter and its sponsors do not accept any responsibility for any entries or prizes that are lost, damaged, unusable or delayed.
2.13. The Winner will not be entitled to payment, credit or otherwise in the event that they do not claim or utilise the prize to the fullest extent possible.
2.14. Any item or value unused will be deemed waived by the Winner.
2.15. Prizes are not transferable and may not be deferred or exchanged for cash, credit or otherwise.
2.16. If any taxes, levies, duties or any charges whatsoever are levied on a prize by any competent authority, the Winner will be liable for these, and the prize value will not be increased to compensate for such charges.
2.17. To the extent that a licence (e.g. driver’s licence), proof of identification or permission (e.g. by a parent/guardian) is required in order to accept or use a prize, the Winner must produce such licence, identification and/or permission for inspection by the Promoter prior to receiving the prize. If a Winner does not or is unable to do so, the prize will be forfeited and another Winner will be drawn under the same terms and conditions.
2.18. The Social Media competition will start on 02 December 2024 at 12pm and end on 16 December 2024 at 12pm. No late entries will be accepted. Winners to be announced by 12pm Wednesday, 18 December on stories and to copy on original post. The Book in store competition will start on 02 December 2024 at 12pm and end on 31 January 2025 at 12pm. No late entries will be accepted. Winners to be announced by 12pm Tuesday, 11 February 2025 by phone call.
2.19. The Winners will be randomly selected by the Promoter’s representatives after the closing date and the selection will be overseen by an independent accountant/auditor/attorney.
2.10. By entering this competition and as condition to receive the prizes, Participants:
2.10.1. Consent to the processing of their personal information by the Promoter(s) and its service providers, but only insofar that it is necessary to give effect to the competition, for example to view the entries, select and announce the Winner and deliver the prizes. The Winners will be given the opportunity to consent to further processing of their personal information;
2.10.2. Waive their moral rights and grant the Promoter exclusive, unlimited, perpetual and free of charge copyright and usage (in any territory where the Promoter trades), in all media forms of all material, text and intellectual property created and/or published/posted by the participants in the submission of their competition entry. The Promoter will be entitled to use and edit the intellectual property in any manner and in its sole discretion, for an indefinite period of time and in any territory where it trades. Participants will not during or after the closing date of the competition dispute or question the copyright and usage by the Promoter;
2.10.3. Waive any right to demand royalties, usage fees or any other form of compensation or payment for the use of intellectual property in the participant’s entry; and
2.10.4. Should they be selected as the Winners, agree to sign an acknowledgment of receipt form in exchange for the prize.
2.20.5. By accepting a prize or by entering this competition, participants hereby indemnify the Promoter and the relevant social media channels against any damage or losses of any nature whatsoever that the participants may suffer arising from this competition and the prizes, including consequential damages and economic loss.
2.10.6. The Winners may be requested to endorse, promote and advertise any of the goods and services of the Promoter and will not unreasonably withhold their consent.
2.10.7. Participants will be deemed to have accepted these Competition Rules by entering the competition. Failure to comply with these rules, or the terms of acceptance of a prize will be deemed to be a rejection of the prize and the Winner will then be disqualified from receiving the prize.
2.10.8. This competition is not organised, sponsored, endorsed by any social media channel.
3. ACCEPTANCE
3.1. By entering the Competition all Eligible Entrants and Winners agree to be bound by these Terms and Conditions.
3.2. These Terms and Conditions will be interpreted by the Promoter, in its sole and absolute discretion and its decision regarding any dispute will be conclusive, final and binding and will not be challenged on any grounds, including without limitation, the grounds that the Promoter failed to act reasonably, fairly, in good faith or otherwise in accordance with the principles or procedural fairness.
3.3. By entering this Competition the Eligible Entrant agrees to receive promotional offers from the Promoter.
3.4. The Promoter reserves the right to amend the Promotional Period of this Competition at any time.
4. PARTICIPATION AND PRIZE
4.1. The Winners will be randomly selected by the Promoter’s representatives after the closing date and the selection will be overseen by an independent accountant/auditor/attorney.
4.2. Except in so far as is provided for in the CPA, the Promoter’s decision is final and no correspondence will be entered into.
4.3. The Winners will be notified via Instagram, Facebook direct message or telephonically after the closing date. If the Promoter is not able to contact a Winner, or the Winner does not provide the Promoter with relevant and correct information timeously, the prize will be forfeited and a new Winner will be re-drawn. The decision of the Promoter as to the Winners are final and no correspondence will be entered into.
4.4. The Social Media Winner will be announced on Instagram and Facebook stories and updated copy on original post
4.5. Delivery of the Prize will be arranged by the Promoter upon receiving valid verification from the Winners.
4.6. The Prize is not transferable and can only be issued in the Winner’s name. Furthermore, the Prize is subject to availability and cannot be exchanged for cash.
4.7. The Promoter reserves the right to substitute the Prize with any other prize of equal value to the Prize offered herein, at its sole and absolute discretion.
4.8. The Winners are responsible for paying for all additional expenses, and all incidental expenses incurred.
4.9. The Promoter will assist the Winners as much as is practicable to ensure the Prize is taken according to these Terms and Conditions. The Winner needs to sign all documentation as required.
4.10. The Promoter reserves the right to disqualify any Winners if they do not respond to a telephone call and e-mail sent to them within 24 (twenty-four) hours of notification thereof, and, in such event, a replacement Eligible Entrant from the competition entries will be chosen as the Winners.
4.11. In such circumstances, the replacement entrant shall be contacted by the Promoter by telephone and e-mailed as soon as reasonably practicable and shall be required to respond to the Promoter in the manner set out in such e-mail.
5. COMPETITION CONDITIONS
5.1. The Promoter shall not be liable for any disruption to the Competition, whether due to technical problems or otherwise, which is beyond its reasonable control. In the event of any disruption to the Competition the Promoter shall use its reasonable endeavours to remedy any disruption and resume the Competition on a fair and equitable basis to the Eligible Entrants.
5.2. The Promoter reserves the right to cancel or amend the Competition or these Terms and Conditions for reasons outside of its reasonable control. In the event of such cancellation, the Eligible Entrant agrees to waive any rights, interests and expectations that he/she may have in terms of the Competition and acknowledges that he/she will have no recourse against the Promoter.
5.3. Any breach of the Terms and Conditions may, at the Promoter’s absolute discretion, result in forfeiture of any Prize. The Promoter has the absolute discretion to decide if participant’s actions constitute any of the actions prohibited in terms of these Terms and Conditions and to end their participation in the competition immediately and take appropriate legal action. 6. PERSONAL DATA AND PRIVACY
6.1. By participating in the Competition, you consent to:
6.1.1. the processing of your personal information (as defined in the POPIA) by the Promoter, any of its operators, agents and sub-contractors (who may be outside South Africa) for statistical, marketing and other purposes, on the condition that they will keep such information confidential and only process such information as allowed in terms of POPIA;
6.1.2. the collection of your personal information from any other source to supplement the personal information which the Promoter has about you as allowed in terms of POPIA;
6.1.3. the retention by the Promoter of your personal information for as long as permitted for legal, regulatory, fraud prevention and/or marketing purposes as allowed in terms of POPIA; and
6.1.4. the Promoter using your personal information (as allowed in terms of POPIA) to send you marketing information about products, services, and special offers of the various companies in the Promoter’s group that may be of interest or value to you.
6.2. The Eligible Entrant will be asked to provide their full name, phone number, e-mail address and age and other related information.
6.3. The Promoter and its Affiliates shall collect and will use your personal data listed hereby in order to enable your participation in this Competition. The storage and use of your personal data always occurs in accordance with POPIA.
6.4. The Promoter keeps the data to fulfil the purposes for which it was collected or as required by applicable laws or regulations.
6.5. The Promoter will not use the Eligible Entrant’s information for a different purpose without first asking permission to do so. The Promoter may however share the entrant’s personal information with any of its subsidiaries worldwide, or with authorized third parties.
6.6. The Promoter does not allow third parties to use your personal information for a different purpose.
6.7. The Promoter treats all information collected as confidential.
6.8. By entering this Promotion, the Eligible Entrant agrees that the Promoter may use and disclose the information they provide in accordance with the Promoter’s Privacy Policy available at https://www.flightcentre.co.za/privacy.
7. OWNERSHIP AND PUBLICITY
7.1. By providing a submission, you grant the Promoter and its Affiliates the right, except where prohibited by law, to use your name for competition purposes in promoting or publicising the Competition, including the right to name the Winners of the Prizes in public.
7.2. The Promoter, however, does not have any obligation to use the entries for any purpose. Details of the Winners may also be announced on the Promoter’s website and any other media properties that it chooses.
7.3. The Promoter, acting reasonably, retains the right to delay the timing of the publication of the Winners of the Competition.
7.4. By entering this Competition, the Promoter reserves the right to communicate with you at any given time during and after the Competition and you may opt out or de-register at any time.
8. INDEMNITY
All Eligible Entrants and Winners hereby indemnify the Promoter, its advertising agencies, advisers, suppliers, and nominated agents against any and all claims, damages or loss howsoever arising, including but not limited to wilful misconduct or negligent acts or omission arising from their participation in this Competition.
9. RELEASE OF LIABILITY
9.1. The Promoter shall not be liable for any loss, damage or consequential damage of any nature in contract, including negligence or otherwise caused by acceptance of these Terms and Conditions in connection with the Prize (to the extent permissible by law).
9.2. This condition does not affect, and is not intended to affect, any rights an Eligible Entrant, as a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the cost of having the Prize supplied again.
9.3. To the extent permitted by law, the Promoter is not responsible for:
9.3.1. inaccurate/incorrect transcription of entry information;
9.3.2. the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website;
9.3.3. unauthorised human intervention in any part of the Competition;
9.3.4. electronic or human error which may occur in the administration of the Competition;
9.3.5. any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its employees or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a Winner and, where applicable, to any family/persons accompanying a Winner; or;
9.3.6. any personal injury or damage to persons or property suffered, including to the Eligible Entrant or any other person's computer related to, or resulting from, participation or downloading any materials in this Competition.
9.4. Any entries found to be duplicate or fraudulent will result in the entrant being excluded from the Competition.
9.5. By participating, all Eligible Entrants release the Promoter, its Affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this Competition from any and all liability with respect to and in any way arising from participation in this Competition, acceptance or use of Prizes.
9.6. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries.
9.7. The Promoter is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Promoter on account of technical problems, human error or traffic congestion on the internet or at any website, or any combination thereof, including any injury or damage to the entrant’s or any other person’s computer relating to or resulting from participation in this Competition or downloading any materials in this Competition.
9.8. Eligible Entrants agree that the Promoter and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever, and will be held harmless by the Winners for any injuries, losses or costs or damage of any kind resulting in whole or in part, directly or indirectly from acceptance, possession, misuse or use of the Prizes or parts thereof, or from participation in this Competition.
9.9. In no event will the Promoter be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, or for travel expenses, lost profits, revenues or business opportunities, even if the Promoter has been advised of the possibility of such damages.

The voucher can only be redeemed at any Flight Centre store in South Africa. The voucher can only be redeemed by the prize Winner and is not transferrable or exchangeable for cash. 1.2. Orms - This voucher can be used online at https://www.ormsdirect.co.za/ and is valid for one year from the date of issue. The voucher can only be redeemed by the prize winner and is not transferrable or exchangeable for cash. This voucher cannot be used in conjunction with any other promotion or price match"
1.3. Standard beauty - the gift card can be used on the standard beauty website or app (www.standard-beauty.co.za). It has no expiry date. The full value can be redeemed in one purchase or spread across multiple smaller purchases. The gift card is non-refundable and cannot be exchanged for cash. It is not transferable and can only be used by the person it was issued to. Standard Beauty reserves the right to modify these terms at any time.
1.4. Havaianas – This voucher is valid exclusively for online use at havaianas.online within South Africa and is valid for 6 months from the date of issue. It can only be redeemed by the prizewinner and is non-transferable or exchangeable for cash. The voucher must be used for purchases made online and is not valid for in-store redemption. Once expired, the
